Description
Leicester City Council and Leicestershire County Council (the “Authority”) invites Tenders for the provision of Probation Health Trainer Service. Leicester City Council is leading the procurement exercise on behalf of the Authority.Probation Health Trainer Service support adults who wish to make a change towards a healthier lifestyle but who are unlikely to make and maintain this without individual support.
Probation Health Trainers are generally ex-offenders and all health trainers must have successfully completed the nationally accredited Health Trainer training and have been assessed as competent to undertake the Health Trainer role. They work with clients on a one-to-one basis, to assess their health and lifestyle risks and support them in their decision to make and sustain behavioural change to a healthier lifestyle.
The proposed Contract will be for an initial period of 1 year (12 months) to commence on 1st April 2019 until 31st March 2020 with an option to extend, subject to satisfactory performance outcomes, ongoing review by the Authority, availability of funding beyond 31st March 2020 which is not guaranteed and agreement by the Authority, for a further period or periods of up to 48 months, i.e. potentially 5 years if the extension options are exercised.
It is the Authority’s view that TUPE is likely to apply in respect of this Contract. TUPE refers to the "Transfer of Undertakings (Protection of Employment) Regulations 2006" as amended by the "Collective Redundancies and Transfer of Undertakings (Protection of Employment) (Amendment) Regulations 2014". However, Tenderers will need to reach their own conclusion as to whether or not TUPE applies.
The procurement process being undertaken is based upon the ‘open’ tendering procedure as defined by the Public Contracts Regulations 2015. This procurement process falls under the Light Touch Regime as defined by the Public Contracts Regulations 2015, Regulation 74 – 77.
